**Midtown Maids Terms of Service**

Please read these Terms of Service ("Terms") carefully before using the midtownmaids.ca website ("Website") or booking any cleaning services ("Services") offered by Midtown Maids ("us", "we", or "our").

Your access to and use of the Website and our Services is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Website and/or our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Website or use our Services.

**Eligibility**

If you are a Midtown Maids potential customer, current customer, or previous customer, or just visiting our website, these terms of service apply to you.

By using our Website and Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

### **Terms of Service**

These Terms of Service constitute an agreement between Midtown Maids and the client. Midtown Maids provides professional cleaning services by trained and vetted cleaning staff.

#### **1. Services Provided**

Midtown Maids offers professional cleaning services, including standard cleaning, deep cleaning, move-in/move-out cleaning, and other residential cleaning services.

#### **2. Payment**

Payment is due at the time of booking. Clients may provide Midtown Maids with a valid credit card for billing. Payments are processed securely through our designated payment processor. Without exception, there are no refunds for cleaning services.

#### **3. Cancellation Policy**

Clients must notify Midtown Maids at least twenty-four (24) hours in advance for cancellations or rescheduling. Failure to do so will result in a $50 cancellation fee. Midtown Maids may waive the fee in cases of emergency, at our sole discretion.

#### **4. Lock Out or No-Show**

It is the client’s responsibility to ensure access to the property. If our cleaning staff are unable to enter, a $50 lock-out fee will apply.

#### **5. Service Satisfaction**

Clients must review the completed service at the time of cleaning. If a client is dissatisfied, they must notify Midtown Maids immediately to resolve the issue. No refunds will be issued for completed services.

#### **6. Direct Hiring Prohibited**

Clients agree not to directly hire or engage with any Midtown Maids cleaning staff for private services during the term of service and for nine (9) months thereafter. If a client hires a Midtown Maids cleaner directly, they agree to pay a $5,000 recruitment fee.

#### **7. Independent Service Providers**

Midtown Maids cleaners are independent service providers. Clients acknowledge that Midtown Maids is not responsible for employment-related liabilities, including tax obligations.

#### **8. Liability Waiver**

Midtown Maids is not liable for loss, damage, or theft of personal property. Clients should secure valuables before cleaning services commence.

#### **9. Termination**

Clients may terminate services at any time. Midtown Maids reserves the right to refuse or terminate services at its discretion.

#### **10. Governing Law**

This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. Any disputes shall be resolved in Toronto courts.

#### **11. Privacy Policy**

Midtown Maids respects your privacy. We will not share your information with third parties except as required for service provision or legal compliance.

#### **12. SMS and Communication Consent**

Clients may receive service-related SMS notifications. Message and data rates may apply. Clients can opt out by replying "STOP."

#### **13. Refund Policy**

No refunds will be issued for cleaning services. If a chargeback is filed, and it is determined that services were provided as agreed, the client agrees to pay Midtown Maids liquidated damages of $750 per occurrence.

#### **14. COVID-19 Acknowledgment**

Clients acknowledge the risks associated with COVID-19 and agree to indemnify Midtown Maids against any claims related to potential exposure.

#### **15. Changes to Terms**

Midtown Maids reserves the right to modify these Terms at any time. Continued use of our services constitutes agreement to the revised Terms.
